Discussion posting rules

Purpose of rules

Clinuvel provides access to Discussions in the good faith that users will abide by the Rules set out below. These rules may change from time to time according to the needs of the Discussions and the Community using them. To suggest changes or improvements to these rules, please contact a moderator directly. Rules are not open to Discussion on the Discussions unless initiated by a moderator.

Any user found in breach of these rules may face disciplinary actions set out under Section 3 of the rules (User Discipline).

Community and user conduct

Users are expected to communicate and interact in a manner which is respectful to other users, including Discussion members, moderators, Clinuvel experts and staff. First and foremost, these Discussions seek to provide users with information of a medical nature. Users are expected to understand that other users may divulge sensitive or personal information and are asked to be respectful of any such disclosure.

The following conduct will not be tolerated anywhere within the Discussion area:

Abuse, insults or personal attacks on either individuals or corporations
Harassment of individuals or corporations
Racism, sexism, religious intolerance, ageism
Conduct which is harmful to minors
Foul or explicit language
‘Trolling’, ‘Flaming’, ‘Baiting’ or ‘Spamming’ or any other conduct which directly affects another users’ ability to access information on the Discussions
Content that is pornographic or obscene in nature
Comments of a defamatory nature to any person or persons living or dead
Content which directly or indirectly proposes, supports or encourages activities which are illegal in nature in the jurisdiction in which they are read
The impersonation of any person or entity including, but not limited to, a Clinuvel representative, or falsely state or otherwise misrepresent an affiliation with a person or entity
Represent as a medical professional or student on the patient Discussions
Advertising of any sort, ‘For Sale’ or ‘Wanting to buy’ posts, without the express written consent of Clinuvel Pharmaceuticals Ltd
Debates of a religious or philosophical nature
Plagiarism, as outlined in section 6 of the rules
Complaints about moderation, please consult the proper channels
Discussion of afamelanotide (CUV1647), its history, clinical trials (past, current or future) or any product claiming to be afamelanotie
Discussion of any unregistered pharmaceutical products
Discussion relating to Clinuvel Pharmaceuticals Ltd which does not lend itself constructively to the thread Discussion
Any conduct which facilitates the availability of software or computer code designed to interrupt, damage or destroy computer software, hardware or telecommunications equipment
Disruption of the Network, its servers or websites

These rules apply to all of the following:

Post contents
Quoting of post contents
Personal/private messages
Posted images
Thread titles
Usernames and profiles
Q and As
Web links on personal pages
Public email addresses
Any other text field you can enter text into

User Discipline

A failure to abide by the rules may result in users being disciplined on the boards by moderators or staff. In the first instance, this may simply be editing of a post with a warning, a short term ban from use or total ban of an account and/or IP address.

In most instances, warning will be given prior to a total ban unless a serious breach of the rules has occurred.

As required by law, Clinuvel Pharmaceuticals Ltd may be required to disclose your information to a third party in instances which may also constitute a breach of these rules. For more information, please see our Privacy Policy.

In all instances, the decisions of a moderator are final and no further communication will be entered into.

Reporting a breach of the rules

Whilst every attempt is made to monitor all content, users may report inappropriate content directly to a moderator by ‘flagging’ an item. ‘Flagged’ content is reviewed by moderators in a timely fashion and may be edited or removed without warning. Users may also report a user or content directly to a moderator where flagging is not possible (ie in private messages).

Users whose content is repeatedly flagged as inappropriate may face discipline as outlined in section 3 of the rules.

You acknowledge that Clinuvel may not pre-screen Content provided by members, but Clinuvel retains the right (but not the obligation) in its sole discretion to refuse or remove any Content that is available via the Network. Without limiting the foregoing, Clinuvel has the right to remove any Content provided by members that violates the terms and conditions or are otherwise objectionable. You agree that You must evaluate and bear all risks associated with the use of any Content provided by members, including any reliance on the accurateness, completeness or usefulness of such Content provided by members.

You acknowledge that by disclosing information in accordance with the Terms and Conditions of use for the Network you are indemnifying the Network and Clinuvel from any claim for any loss, damage, or harassment which may occur by this information being available on the Internet.

Q and As

As part of the Discussions, an Question and Answer (Q and A) style service is offered to help users better understand the science behind medical conditions as well as those conditions and their treatments. To do this, Clinuvel Pharmaceuticals Ltd has engaged a number of experts in their chosen fields to create a database of Q and As as well as building on this database with Questions from users. Whilst every effort is made to ensure the accuracy of these Questions, users should be aware that this information is for self-educational purposes only.

The information provided is not a substitute for professional, medical and health advice. Do not interpret or use this information to diagnose or treat a health problem or disease without consulting a professionally qualified health care provider. Please consult a relevant health care provider if you have any questions or concerns or if you wish to determine the information you are relying on is appropriate for your medical conditions.

Users must understand that Questions may take some time to answer, depending on the complexity and nature of the Question asked. Every effort is made to answer Questions within 48 hours, however Clinuvel Pharmaceuticals reserves the right to postpone, ignore or reject questions on their own merits. Given the database of Q and As currently available, users must accept that their question, just phrased in a different manner, may already by answered, in which instance they will be sent or directed to the relevant Q and A. Users acknowledge that use of their the Q and A system may also constitute a breach of these rules and result in disciplinary action.

Plagiarism and copyright material

Any instances of plagiarism or unauthorized publishing of copyright material will not be tolerated on these Discussions. Users are permitted to quote or source material relevant to a Discussion or line of argument, provided that no greater than 10% of a total source document is quoted. This applies to all reference and media materials in accordance with Australian law. Where referencing a larger section of a document or website, please provide a legitimate link to that site for other users to review. Users are responsible for the content of the links they post and should warn other users of the nature of the content linked to.

Moderators will not tolerate plagiarism, deliberate or accidental, and have the right to edit any post by a user that may constitute plagiarism. For this purpose, plagiarism is the unaccredited copying of work by another person which a user claims as their own.

Suggestions and complaints

Clinuvel Pharmaceuticals Ltd recognizes that online communities will evolve and that these Discussions may not provide a suitable environment for all users. Whilst every effort is made to address these issues online through a moderator and the protocol in place, users are able to forward any communications regarding suggestions or complaints in writing directly to the webmaster at Clinuvel:
