Acceptance of Terms

These Terms apply to the Clinuvel Communication Platform and aggregation of websites (“Platform”), owned and operated by Clinuvel Pharmaceuticals Ltd (ABN: 88 089 644 119) (“Clinuvel”). Your access to the Platform is conditional upon Your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Platform (known collectively as "Terms & Conditions"). Your use of, and/or access to, the Platform constitutes Your agreement to the Terms & Conditions. Clinuvel reserves the right to alter the Terms & Conditions at any time, without notice. Since You are bound by these Terms & Conditions, You should periodically refer to them in this document and elsewhere on the Platform.

Description of service

Clinuvel provides You with access to its online database of information (“Content”) including, but not limited to, text, images, videos, communications tools, Discussions and like services through the Communication Platform (“Service”). You also understand that the Service may, in future, contain advertisements to assist in providing the Service. You also understand that Clinuvel may, from time to time, contact you regarding updates to the Service or relevant information for Your membership and that you cannot opt out of them. You understand that the Service is provided “As-is” and that Clinuvel is not responsible for the manner or timeliness in which user communications or personalized settings are updated or stored.

Privacy Policy

Your registration and personal details will be stored by Clinuvel, subject to our Privacy Policy, click here for a copy. As with the Terms & Conditions, the Privacy Policy will be updated from time to time to reflect relevant legislation and/or community standards. You should check the Privacy Policy regularly to ensure You are familiar with its contents.

Member account, password and security

Certain parts of the Platform require users to register their details and log in each time they wish to access these areas of the Platform (“Membership”). If You do register (becoming a “Member”), You are responsible for maintaining the security of Your username, password and any other identifying information. Members assume full responsibility for any activities that occur during the use of their username and password or account.

As part of this, members must: 

• Log out of their account at the end of each session;
• Notify Clinuvel immediately of any breach of security to their Membership

Clinuvel is not responsible for any loss or damage as a result of a Members’ failure to comply with these requirements.

Discussion rules

As part of its Service, Clinuvel offers access to read, review and post on a series of Discussions. These Discussions are governed by their own Rules, which can be viewed here. By accepting the Terms & Conditions, You also accept the Discussions Rules. We strongly recommend that You review the Discussions Rules prior to engaging in the Discussions and periodically during Your use of the Platform as these Rules may change without notice.

Content

You understand that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the User from whom that Content originated. You are responsible for all Content that You make available via the Platform (whether a post, private message, email or other type of communication). Clinuvel does not control the Content posted by You and other members via the Platform, and as such does not guarantee its accuracy, integrity or quality. You understand by using the Platform You may be exposed to Content that is offensive, indecent or objectionable. In these instances You should alert Clinuvel to this content via mail@clinuvel.com. You also accept that You may be exposed to content of a graphic medical nature.

Under no circumstances will Clinuvel be liable in any way for any Content, including but not limited to any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Platform.

You understand that technical processing and transmission of the Platform including Your Content may involve:

• Transmissions over other communications networks, including, but not limited to Search Engines, wire services and ‘alerts’ systems; and
• Changes to adapt the Platform to technical requirements of connecting networks or devices

You understand that the Platform may include security components that permit digital materials to protect it and the use of these materials is subject to usage rules, set by Clinuvel and/or Content providers who provide Content to the Service. You may not attempt to override or circumvent any of the usage rules embedded in the Platform. Any reproduction, publication, further distribution or public exhibition of materials provided on the Platform in whole or in part is strictly prohibited, unless otherwise stated, and will be seen as a breach of copyright without the express written approval of Clinuvel. All content and images governed by GNU licenses are acknowledged as such and will be linked to the appropriate licensing information.

Notice and procedure for making claims of copyright or intellectual property infringement

Clinuvel and You are bound to respect the intellectual properties of all others. As set out in the Discussions Rules, You may be banned from the Communication Platform for repeat  and/or serious infringements of copyright. If You find a work or works that You believe has breached copyright or infringed Your intellectual properties, You must contact Clinuvel in writing, outlining the following:

• The date You sent the communication to Clinuvel
• Your full contact details, including Your right to represent the person or persons whose copyright may have been infringed, a postal address, email address and contact telephone number, along with a statement that Clinuvel may contact You
• A description of the work or works believed to be infringing copyright
• An exact location of the work or works on the Network
• A signed statement by You that You, in good faith believe that the work or works have been used without authorization from the copyright owner, their agent or the law
• A signed statement, made under penalty of perjury, by You that the above information is accurate and that You are authorized to act by the copyright owner of the work or works outlined.

Clinuvel will address Your concerns in a timely manner in cooperation with the law. In most instances this will include:

• Suspending any disputed material within a timely manner
• Contacting you directly regarding the disputed material within a reasonable timeframe, usually one (1) working week

Clinuvel strongly recommends sending a dated hard copy of any material to the postal address and cannot guarantee that information sent via email will be received and acted upon.

General information

You agree that these terms and conditions and Your access to the Web Site are governed by the laws of Victoria, Australia and You agree to submit to the exclusive jurisdiction of the Courts located within the State of Victoria for any disputes.

You acknowledge that these Terms & Conditions constitute the entire agreement between You and Clinuvel and govern Your use of the Platform superseding any prior agreement between You and Clinuvel.

You may also be subject to additional Terms & Conditions that may apply when You use or purchase other services from Clinuvel.

The failure of Clinuvel to exercise or enforce any right or provision of the Terms & Conditions shall not constitute a waiver or any such right or provision. If any provision of the Terms & Conditions is found by a Court of competent jurisdiction to be invalid, the parties nevertheless agree that the Court shall endeavor to give effect to the parties' intentions as reflected in the provision and the other provisions of the Terms & Conditions shall remain in full force and effect.

You indemnify Clinuvel against any losses or damages caused by downloading Content from the Web Site which contains viruses, worms, Trojan horses or other destructive codes of any form.
